JOHN THALLEMER

Partner

John Thallemer has a wide range of experience advising clients and litigating intellectual property matters in pharmaceutical, medical device, and chemical patent cases. He regularly prepares opinions and provides client counseling on patentability, infringement, and validity issues.


Prior to joining Kratz & Barry, John was Director of IP at Hetero USA, Inc., a global generic pharmaceutical company. As in-house counsel, he coordinated and executed patent litigation strategy on dozens of U.S. pharmaceutical patent cases filed under the Hatch-Waxman Act; managed outside counsel; performed freedom-to-operate and patentability analyses; regularly advised senior management on litigation risks and results; conducted internal training on patent litigation, patentability of inventions, and U.S. Food & Drug Administration (FDA) regulatory issues; and negotiated many case settlements.


Previously, John was Senior Patent Counsel at Novartis, a brand pharmaceutical company, where he was responsible for all IP associated with the Respiratory Group. He also drafted and prosecuted more than 100 patent applications for the Chemical Analytical Development Group. Before becoming an attorney, John worked as a chemist for Nalco Chemical Company developing polymers for use in water-treatment, paper

manufacturing, and oil recovery applications.


John continues to represent young entrepreneurs in pro bono cases before the U.S. Patent and Trademark Office to help them obtain IP protection for their inventions.
